Warum meine Blogs nicht unter CC stehen…

Bei Udo Vetter ist in den letzten Tagen eine interessante Diskussion um Sinn und Unsinn von Aggregatoren und das vermeintlich konkludente Einverständnis in die Weiterverbreitung als RSS veröffentlichter Volltext-Artikel entstanden.

Stein des Anstosses war ein einfacher privater Aggregator, der unter dem etwas unglücklichen URL http://kinder.verbrennung.org/ eine bunte Sammlung von Blogs im Volltext übernahm. Der Betreiber des Aggregators versicherte, dass er keinesfalls kommerziell handeln würde und den Aggregator nur als Feedreader nutzen würde. Ich glaube ihm. Er muss sich dennoch den Vorwurf gefallen lassen, nicht nachgedacht und damit andere geschädigt zu haben.

Warum lasse ich nur Aggregatoren zu, wenn deren Betreiber mich vorher gefragt haben oder ich selbst um Aufnahme gebeten habe?

Ganz einfach: bereits als es kein Rootserverexperiment gab und nur /dev/corner existierte, musste ich manchmal ansehen wie meine Texte auf anderen Webseiten auftauchten, die durch geschickte Aggregation verschiedener thematisch verwandter Seiten deutlich besser gerankt waren als meine. Schierer Neid und Mißgunst meinerseits? Vielleicht — vielleicht gefällt es mir einfach nicht, wenn jemand anderes von meiner Arbeit profitiert, ohne etwas zurückzugeben.

Aber Du schreibst über Opensource, erstellst angepasste Distributionen und profitierst auch davon?

Ja, das mache ich. Und ich bin froh, dass es sehr strikte Lizenzen wie die GPL gibt, welche die Nutzung nicht einschränken, aber die Anpassung und Weitergabe modifizierter Quellcodes regeln. Leider ist das Beispiel Software nicht ganz auf Textwerke übertragbar. Eine generelle Freigabe meiner Texte auch unter einer NC Creative-Commons-Lizenz hätte zur Folge, dass viele scheinbar private und nichtkommerzielle Aggregatoren unter griffigen Domainnamen sprießen würden, die dann mit hohem Pagerank wunderbare Summen erzielen. Wenn dann die kommerzielle Absicht erkennbar ist, ist es zu spät.

Wer einen ernsthaften Aggregator zu OSS-Themen betreibt oder meine Texte für ein Wiki oder eine HOWTO-Sammlung übernehmen möchte, frage doch einfach nach und bekommt dann meist die Erlaubnis.

Ich bin bestimmt kein Content-Schwein, das gleich abmahnt, ich helfe gerne und ich stelle Texte ins Netz: Ihr profitiert von Tutorials und bekomme im Gegenzug Reputationseffekte.

Aber Du hast doch Feeds!

Ich kann nicht nachvollziehen, wie aus der einfachen Bereitstellung eines Feeds — der lediglich eine andere Darreichungsform des Contents der HTML-Version ist — implizit auf ein Recht zur Weiterverbreitung geschlossen werden kann.

Noch weniger kann ich nachvollziehen, dass viele Diskussionsteilnehmer die Unart der vollständigen Übernahme fremder Inhalte gutheissen und stattdessen, den Erzeuger von Inhalten dazu auffordern, es doch ausdrücklich zu erwähnen, wenn sie es wünschen, dass Ihre Texte den gesetzlichen Schutz genießen.

Wenn die Mißachtung fremder Rechte zur Norm wird und die in ihren Rechten verletzten Urheber sich den Vorwurf des fehlenden Verständnisses von “Web 2.0″ gefallen lassen müssen, dann läuft etwas ganz gewaltig schief.

So, ich hoffe, nicht allzuviele Leser verschreckt zu haben. Fragt einfach nach, ob Ihr im Volltext aggregieren dürft. Bei Planets, dessen Kontext mir gefällt, dürfte wenig entgegenstehen.

    ähm, ich benutzte RSS Aggregation!
    Ich lese sie – empfehle SAGE – aber ich würde niemals auf die Idee kommen, den Inhalt (ohne zu fragen) in meine Seite einzubinden.
    Ich würde auch nicht auf die Idee kommen und Bilder von flickr zu kopieren und die dann auf meiner Seite zu präsentieren.
    Aber deswegen die RSS-Feeds abzuschalten macht doch keinen Sinn!
